What is Verifactu?

I will recap it quickly. Verifactu is the new billing assurance system from the Spanish government, that is, the sending and registration of invoices required by the Tax Agency to try to prevent and control tax fraud.The objective is to ensure the integrity, traceability and accuracy of all invoices issued by companies and the self-employed.In practice, it means that your billing software must generate files with a specific format validated by the Tax Agency, which is reliable and unalterable and that offers the option of sending the documentation directly to the Tax Agency (it is voluntary to do so for now, but the program must provide that alternative).You do not necessarily have to change software, but you do have to ensure that you are operating with one that is approved, that does things in the proper way.In short, it is what is called adapting to a technical standard to avoid incidents and tax fraud, but not a change that impacts your daily way of working.

When and for whom is Verifactu mandatory?

Although the different billing softwares are required to be adapted and approved since last July 2025, the reality is that Verifactu is going to be mandatory from January 1, 2027 for all companies, public limited or limited, that pay corporation tax.Do the self-employed have to adopt Verifactu? Indeed, self-employed workers also have to use an approved billing program, although in their case, there is a little more leeway, since the obligation starts a little later, specifically on July 1, 2027.In short: all individuals and entities that carry out activities subject to invoice issuance must ensure that they use a program adapted to the new requirements of the Tax Agency, whether in January or July depending on what applies to them.For all those who fail to comply with this rule after the implementation period, the law provides for fines and they are not small.I do not want to scare you, but if you use a non-approved program, you face a possible penalty of up to 50,000 euros/year. This occurs even if there is no irregularity or fraud as such, and your accounts are as clean as a whistle.As they say: it is no joke, certainly.
